By commissioning me, you agree to the terms of service below~

Any statement can be bound to change if discussed with me, the artist, prior to the commission.

I. GENERAL TERMS

Please write in a clear and nice manner. The safest way to contact me is via Twitter, Instagram, Facebook, Tumblr, Reddit, email or DeviantArt. Links to these are here: https://linktr.ee/Manishachan

Provide references, this can be a detailed description with images to aid you on what you want the commission to look like, and /or existing reference images. Let me know the general pose / expression / vibe you would like for the piece.

Any ill behaviour and/or disrespect will not be tolerated and your commission will be cancelled if it occurs. If you are underage, please make sure that you have the permission of your guardians to commission me. If you need the order fast, I will apply a rush fee. Please only order if you are ready to pay and have the money available. Please don't back off if you have already ordered. I can refuse your request for a commission for any reason. If you ignore any of the above, you may get blocked.

You can always ask/tell me about your commission request and I will let you know if I’m happy to do it or not.

II. PAYMENT

All commissions can be paid: after the sketch, in full upfront, or half upon starting, and the rest when nearing completion. The currency accepted is GBP (Great British Pounds) (£), any currency you use can be converted to the correct amount needed in GBP. I primarily use PayPal, but also have CashApp.

III. PROCESS

Work In Progress will be given, unless the commissioner doesn’t want them. The estimated time for your commission to be completed: For sketches, chibis, and simple colour: 1-5 days. For black & white, traditional and fully rendered: 1-6 weeks, depending on many factors such as; health, order of commission, complexity, work, or family issues.

If any of the things stated above occurs, you will be notified asap.

IV COPYRIGHT / USAGE POLICY

I, the artist, hold every right to the produced drawing, not the commissioner.

Therefore, I´m allowed to use the copyrighted artwork to;

-Promote myself with in any place or site.

-Publish books with.

-To display it anywhere to my liking.

-Post it wherever I want (unless the commissioner wishes to keep the commission private.)

COMMERCIAL USE IS 300% OF BASE PRICE

You may NOT use my artwork for commercial purposes. Selling my artwork on T-shirts, mugs, etc. will not be allowed, and legal altercations can take place. With permission beforehand, you are allowed to use the commission for a profile picture or a banner.

You are NOT allowed to make any of the following edits to my artwork for any reason: Stealing, Tracing, Editing, Recoloring, Copying, Claiming the image as yours, Screenshotting, Selling, Remaking, Referencing from, Removing my watermarks, Or making a base from my art.

In addition to copyright, certain authors of works of visual art also have the rights of attribution and integrity as described in section 106A of the 1976 Copyright Act. It is illegal for anyone to violate any of the rights provided by the copyright law to the copyright holder. (Source: Artists Rights Society, www.arsny.com/copyright-basics/)

For non-commercial commissions, I grant you (the client) an Exclusive license, with modification rights. You have the perpetual and worldwide right and license to use, distribute, reproduce, adapt, modify and display the final work so long as no profit is made from the work, and proper credit is given to me. Credit includes linking to my social media pages, and/or my website.

The commissioner is allowed to;

-Use the copyrighted artwork for personal use only unless agreed otherwise.

-Print the art, and claim the right of their character(s) but not the drawing itself.

-Use the art to promote themselves with proper credit given to the artist.

-For personal use you can repost but please tag me. If you wish to use this for business you need to inquire about owning the rights to it, this will be an added charge.

If you break the copyright infringement in any way, every right you had to the drawing will be retracted.

Always give credit if you use/repost the commission. Don't claim it as yours.

The following is considered Copyright infringement:

-Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way)

-Taking Credit for the creation of the artwork.

-Removing any watermarks/signatures.

-Altering the artwork without my, the artist´s, consent.

-A Purchase of Commercial rights to the artwork will always be 300% of original price.

With commercial rights you are allowed to make any sort of merch with the artwork. Use it in books, covers, as Props, change it to your liking and promote your own brand with. Credit is still required for usage of the artwork, even if altered or edited.

V. CUSTOMER SATISFACTION

I will do everything I can to make my clients happy. During the sketch stage, I will make changes for free until you’re satisfied to continue, but if you want over 3 major changes/new sketches, I will charge for the extra work. After a commission is finished, only small changes are allowed to be made, such as small colouring/marking mistakes. Any great changes will come with an extra charge, such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely.

VI. CANCELING/REFUNDING POLICY

I have the right to cancel and refund the money for your commission at any time.

You have no right to cancel or demand a refund from the artist under any circumstances after payment are received. If money has not been sent yet the commissioner has the right to cancel the commission.
